Payment
of first & last months' rental for system ordered, plus any options
& activation fee required with order. Standard rates, billed in
6-second increments, for calls within the Continental U.S., AK, HI,
Puerto Rico, Canada, and U.S. Virgin Islands: inbound toll-free number
calls are 6.9cents/min; outbound calls for message call-backs, paging,
fax-back, etc. are cents/min. Standard connected live-call-transfer,
call return, and cardless calling card calls are billed at
11.3cents/min. Calls from pay phones carry a 54 cent surcharge per
call, mandated by the FCC, which is passed on to you at cost. Multiple
cardless calling card calls can be made with only one surcharge.
Monthly charges will be automatically deducted from your credit card or
billed according to the payment method you have selected. Call charges
will be deducted from your credit card once your usage has reached 75%
of your activation fee, or if you selected the check pay payment
method, billed when 75% o the additional deposit has been used.
It
is the customer's responsibility to maintain sufficient balance on
credit card account to allow settlement of charges. If paying by check,
customer is responsible for immediate payment of invoices and
maintaining sufficient balance on account so that prepayment is not
exceeded by call & usage charges. Interruption of service will be
experienced in the event that credit card account balance or prepayment
balances are not maintained. Returned checks will result in a $25
returned check fee being applied to your account.
It
is specifically understood and agreed that the purchaser shall be using
this service solely for lawful and appropriate purposes and the
purchaser hereby agrees to indemnify and hold FreedomVOICE Systems
harmless from any and all claims of any nature whatsoever arising out
of or concerning purchaser's use in any manner of the services provided
herein. In the event that FreedomVOICE Systems is brought into
any action arising from or concerning purchaser's activities, purchaser
agrees to indemnify and hold FreedomVOICE systems from all arbitration,
court and attorney's costs and fees.
This Agreement shall be governed by the laws of the State of California
and any disputes or controversy arising hereunder shall be arbitrated
or adjudicated in San Diego County, State of California.
Purchaser hereby consents to personal jurisdiction for all claims of
any nature concerning purchaser and FreedomVOICE Systems in San Diego,
California and specifically consents to service of process being
effectuated by certified mail at purchaser's address. In the
event that any action is brought to enforce or construe any term or
condition of this agreement, or for the breach of this Agreement, or
concerning the indemnification clause contained herein, the prevailing
party shall be entitled to recover, in addition to all other damages,
reasonable attorney's costs and fees.
Service although reliable is not guaranteed. Liability for interruption
of service and/or a lack of quality of service including but not
limited to errors and omissions relating to directory listing and CNAM
shall be limited to a maximum of two months voice systems rental. We
reserve the right to interrupt service for maintenance and systems
upgrades at our discretion.
It is specifically understood and agreed that the format of services
provided and all programs associated with the services provided under
this agreement are FreedomVOICE System's proprietary materials and
information and that purchaser shall not, without the prior written
approval of FreedomVOICE Systems copy, duplicate, communicate or modify
format of services provided and all programs associated with the
services provided under this agreement
It is specifically agreed that FreedomVOICE Systems may identify
purchaser as a customer of FreedomVOICE Systems and include
customer’s name and logo in FreedomVOICE Systems’s marketing
material that identify FreedomVOICE Systems’s customers.
Service may be cancelled at anytime upon 30 days notice.
If paying by credit card and your card is charged successfully, in most
cases, you will be set up with your toll-free number, PIN and
instruction guide immediately. If paying by check or money order, or at
certain times when instant set up is not available, your service is
normally set up within 24-48 hours after receiving payment for your
services.
Money-back up to 30-days, if not fully satisfied - you only pay call charges incurred!
